If no employ\u00adment con\u00adtract is con\u00adcluded with the appli\u00adcant, the appli\u00adca\u00adti\u00adon docu\u00adments will be auto\u00adma\u00adti\u00adcal\u00adly era\u00adsed after informing the appli\u00adcant about the rejec\u00adtion, unless such era\u00adsu\u00adre con\u00adflicts with AXI\u00adCA\u2019s other legi\u00adti\u00adma\u00adte inte\u00adrests. Such a legi\u00adti\u00adma\u00adte inte\u00adrest could be the obli\u00adga\u00adti\u00adon to fur\u00adnish pro\u00adof pur\u00adsu\u00adant to the All\u00adge\u00admei\u00adne Gleich\u00adbe\u00adhand\u00adlungs\u00adge\u00adsetz (AGG) (Ger\u00adman Gene\u00adral Equa\u00adli\u00adty of Tre\u00adat\u00adment Act).<\/p>\n\n\n\n5. Opt-out and era\u00adsu\u00adre opti\u00adon<\/strong>
The coll\u00adec\u00adtion of the data is neces\u00adsa\u00adry for car\u00adry\u00ading out the appli\u00adca\u00adti\u00adon pro\u00adce\u00addu\u00adre. Appli\u00adcants can object to the pro\u00adces\u00adsing of their data at any time. If they do, it should be noted that com\u00adple\u00adti\u00adon of the appli\u00adca\u00adti\u00adon pro\u00adce\u00addu\u00adre may not be possible.<\/p>\n\n\n\nX. - infor\u00adma\u00adti\u00adon about the rights of having the per\u00adso\u00adnal data rela\u00adting to him or her cor\u00adrec\u00adted or era\u00adsed or the right to rest\u00adric\u00adtions on pro\u00adces\u00adsing by the con\u00adtrol\u00adler or the right to object to such processing<\/li>\n\n\n\n
- infor\u00adma\u00adti\u00adon about the right to com\u00adplain to the authorities<\/li>\n\n\n\n
- all available infor\u00adma\u00adti\u00adon about the ori\u00adgin of the data, if the per\u00adso\u00adnal data were not coll\u00adec\u00adted direct\u00adly from the data subject,<\/li>\n\n\n\n
- infor\u00adma\u00adti\u00adon about the exis\u00adtence of an auto\u00adma\u00adted decis\u00adi\u00adon-making pro\u00adcess, inclu\u00adding pro\u00adfil\u00ading pur\u00adsu\u00adant to Art. 22 Paras. 1 and 4 GDPR and \u2014 at least in the\u00adse cases \u2014 meaningful infor\u00adma\u00adti\u00adon about the logic invol\u00adved as well as the impli\u00adca\u00adti\u00adons and the inten\u00added effects of such pro\u00adce\u00addu\u00adres on the data subject.<\/li>\n<\/ul>\n\n\n\n
In addi\u00adti\u00adon, the data sub\u00adject is entit\u00adled to be infor\u00admed as to whe\u00adther per\u00adso\u00adnal data were trans\u00admit\u00adted to a third coun\u00adtry or an inter\u00adna\u00adtio\u00adnal orga\u00adni\u00adsa\u00adti\u00adon. Should this be case, the data sub\u00adject also has the right to be infor\u00admed of all sui\u00adta\u00adble gua\u00adran\u00adtees rela\u00adting to this transmission.<\/p>\n\n\n\n
If a data sub\u00adject wis\u00adhes to exer\u00adcise this right of access, he or she can do so at any time by cont\u00adac\u00adting the con\u00adtrol\u00adler respon\u00adsi\u00adble for data processing.<\/p>\n\n\n\n
3. Right to rec\u00adti\u00adfi\u00adca\u00adti\u00adon:<\/strong>
Every data sub\u00adject impac\u00adted by the pro\u00adces\u00adsing of per\u00adso\u00adnal data has the right to demand that any incor\u00adrect per\u00adso\u00adnal data con\u00adcer\u00adning him or her be rec\u00adti\u00adfied wit\u00adhout undue delay. Taking into account the pur\u00adpo\u00adses of the pro\u00adces\u00adsing, the data sub\u00adject also has the right to have incom\u00adple\u00adte per\u00adso\u00adnal data com\u00adple\u00adted \u2014 inclu\u00adding by means of pro\u00advi\u00adding a sup\u00adple\u00admen\u00adta\u00adry statement.<\/p>\n\n\n\nIf a data sub\u00adject wis\u00adhes to exer\u00adcise this right to rec\u00adti\u00adfi\u00adca\u00adti\u00adon, he or she can do so at any time by cont\u00adac\u00adting the con\u00adtrol\u00adler respon\u00adsi\u00adble for processing.<\/p>\n\n\n\n
4. Right to era\u00adsu\u00adre (Right to be for\u00adgot\u00adten):<\/strong>
Every data sub\u00adject impac\u00adted by the pro\u00adces\u00adsing of per\u00adso\u00adnal data has the right to obtain from the con\u00adtrol\u00adler the era\u00adsu\u00adre of the per\u00adso\u00adnal data con\u00adcer\u00adning him or her wit\u00adhout undue delay, whe\u00adre one of the fol\u00adlo\u00adwing grounds app\u00adly and to the ext\u00adent that the pro\u00adces\u00adsing is not neces\u00adsa\u00adry:
The per\u00adso\u00adnal data is no lon\u00adger neces\u00adsa\u00adry to imple\u00adment the pur\u00adpo\u00adses for which they were coll\u00adec\u00adted or other\u00adwi\u00adse pro\u00adces\u00adsed.
The data sub\u00adject has with\u00addrawn his or her con\u00adsent on which the pro\u00adces\u00adsing was based in accordance with Art. 6 Para. 1 lit a GDPR or Art. 9 Para. 2 lit a GDPR, and the\u00adre is no other legal basis for the pro\u00adces\u00adsing.
The data sub\u00adject objects to the pro\u00adces\u00adsing pur\u00adsu\u00adant to Art. 21 Para. 1 GDPR, and the\u00adre are no over\u00adri\u00adding legi\u00adti\u00adma\u00adte reasons for the pro\u00adces\u00adsing, or the data sub\u00adject objects to the pro\u00adces\u00adsing pur\u00adsu\u00adant to Art. 21 Para. 2 GDPR.
The per\u00adso\u00adnal data have been unlawful\u00adly pro\u00adces\u00adsed.
The per\u00adso\u00adnal data must be era\u00adsed for com\u00adpli\u00adance with a legal requi\u00adre\u00adment under Uni\u00adon or Mem\u00adber Sta\u00adte law, to which the con\u00adtrol\u00adler is sub\u00adject.
The per\u00adso\u00adnal data have been coll\u00adec\u00adted in con\u00adnec\u00adtion with an offer of infor\u00adma\u00adti\u00adon socie\u00adty ser\u00advices pur\u00adsu\u00adant to Art. 8 Para. 1 GDPR.
If any of the reasons men\u00adtio\u00adned abo\u00adve appli\u00ades and a data sub\u00adject wis\u00adhes to obtain the era\u00adsu\u00adre of per\u00adso\u00adnal data held by AXICA, they can do so at any time by cont\u00adac\u00adting the con\u00adtrol\u00adler respon\u00adsi\u00adble for pro\u00adces\u00adsing. In this case, the data sub\u00adjec\u00adt\u2019s request for era\u00adsu\u00adre will be met immediately.<\/p>\n\n\n\nWhe\u00adre the per\u00adso\u00adnal data were made public by AXICA and whe\u00adre our com\u00adpa\u00adny as the con\u00adtrol\u00adler is obli\u00adged pur\u00adsu\u00adant to Art. 17 Para. 1 GDPR to era\u00adse the per\u00adso\u00adnal data, AXICA, taking into account available tech\u00adno\u00adlo\u00adgy and the cost of imple\u00admen\u00adta\u00adti\u00adon, will take reasonable steps, inclu\u00adding tech\u00adni\u00adcal mea\u00adsu\u00adres, to inform con\u00adtrol\u00adlers respon\u00adsi\u00adble for the data pro\u00adces\u00adsing who have pro\u00adces\u00adsed the published per\u00adso\u00adnal data that the indi\u00advi\u00addu\u00adal con\u00adcer\u00adned has reques\u00adted the era\u00adsu\u00adre by such con\u00adtrol\u00adlers of any links to, or copy or repli\u00adca\u00adti\u00adon of, tho\u00adse per\u00adso\u00adnal data, inso\u00adfar as the pro\u00adces\u00adsing is not requi\u00adred. The con\u00adtrol\u00adler respon\u00adsi\u00adble for the pro\u00adces\u00adsing will then take the appro\u00adpria\u00adte steps in the indi\u00advi\u00addu\u00adal case.<\/p>\n\n\n\n
5. Right to rest\u00adric\u00adtion of pro\u00adces\u00adsing:<\/strong>
Every data sub\u00adject impac\u00adted by the pro\u00adces\u00adsing of per\u00adso\u00adnal data has the right to obtain from the con\u00adtrol\u00adler rest\u00adric\u00adtion of pro\u00adces\u00adsing, whe\u00adre one of the fol\u00adlo\u00adwing con\u00addi\u00adti\u00adons apply:<\/p>\n\n\n\nThe accu\u00adra\u00adcy of the per\u00adso\u00adnal data is con\u00adtes\u00adted by the data sub\u00adject, for a peri\u00adod enab\u00adling the con\u00adtrol\u00adler to veri\u00adfy the accu\u00adra\u00adcy of the per\u00adso\u00adnal data.
The pro\u00adces\u00adsing is unlawful, the data sub\u00adject has rejec\u00adted the era\u00adsu\u00adre of the per\u00adso\u00adnal data and demands rest\u00adric\u00adtion of their use ins\u00adtead.
The con\u00adtrol\u00adler no lon\u00adger needs the per\u00adso\u00adnal data for the pur\u00adpo\u00adses of pro\u00adces\u00adsing, but they are still nee\u00added by the data sub\u00adject for estab\u00adli\u00adshing, exer\u00adcis\u00ading or defen\u00adding his or her legal claims.
The data sub\u00adject has objec\u00adted to the pro\u00adces\u00adsing pur\u00adsu\u00adant to Art. 21 Para. 1 GDPR, and it has not yet been veri\u00adfied whe\u00adther the legi\u00adti\u00adma\u00adte grounds of the con\u00adtrol\u00adler over\u00adri\u00adde tho\u00adse of the data subject.<\/p>\n\n\n\n
Whe\u00adre any of the con\u00addi\u00adti\u00adons men\u00adtio\u00adned abo\u00adve are pre\u00adsent and the data sub\u00adject wis\u00adhes to obtain rest\u00adric\u00adtion of the per\u00adso\u00adnal data held by AXICA, they can do so at any time by cont\u00adac\u00adting the con\u00adtrol\u00adler respon\u00adsi\u00adble for the pro\u00adces\u00adsing. In this case the rest\u00adric\u00adtion of pro\u00adces\u00adsing will be imple\u00admen\u00adted immediately.<\/p>\n\n\n\n
6. Right to data por\u00adta\u00adbi\u00adli\u00adty:<\/strong>
Every data sub\u00adject impac\u00adted by the pro\u00adces\u00adsing of per\u00adso\u00adnal data has the right to be given the per\u00adso\u00adnal data con\u00adcer\u00adning him or her, which such indi\u00advi\u00addu\u00adal pro\u00advi\u00added to a con\u00adtrol\u00adler, in a struc\u00adtu\u00adred, com\u00admon\u00adly used and machi\u00adne-rea\u00adda\u00adble for\u00admat. A data sub\u00adject also has the right to trans\u00admit tho\u00adse data to ano\u00adther con\u00adtrol\u00adler wit\u00adhout hin\u00addrance from the con\u00adtrol\u00adler to which the per\u00adso\u00adnal data have been pro\u00advi\u00added, whe\u00adre the pro\u00adces\u00adsing is based on con\u00adsent given pur\u00adsu\u00adant to Art. 6 Para. 1 lit. a GDPR or Art. 9 Para. 2 lit. a GDPR or on a con\u00adtract pur\u00adsu\u00adant to Art. 6 Para. 1 lit b GDPR; and the pro\u00adces\u00adsing is car\u00adri\u00aded out by auto\u00adma\u00adtic means, and inso\u00adfar as the pro\u00adces\u00adsing is not neces\u00adsa\u00adry for the per\u00adfor\u00admance of a task car\u00adri\u00aded out in the public inte\u00adrest or in the exer\u00adcise of offi\u00adci\u00adal aut\u00adho\u00adri\u00adty con\u00adfer\u00adred on the con\u00adtrol\u00adler.
In exer\u00adcis\u00ading his or her right to data por\u00adta\u00adbi\u00adli\u00adty, the data sub\u00adject has the right pur\u00adsu\u00adant to Art. 20 Para. 1 GDPR to have the per\u00adso\u00adnal data trans\u00admit\u00adted direct\u00adly from one con\u00adtrol\u00adler to ano\u00adther, whe\u00adre tech\u00adni\u00adcal\u00adly fea\u00adsi\u00adble and if this does not adver\u00adse\u00adly affect the rights and free\u00addoms of others.
Whe\u00adre the data sub\u00adject wis\u00adhes to exer\u00adcise the right to por\u00adta\u00adbi\u00adli\u00adty, he or she can do so at any time by cont\u00adac\u00adting the con\u00adtrol\u00adler respon\u00adsi\u00adble for data processing.<\/p>\n\n\n\n7. Right to object:<\/strong>
Every data sub\u00adject impac\u00adted by the pro\u00adces\u00adsing of per\u00adso\u00adnal data has the right to object, on grounds rela\u00adting to his or her par\u00adti\u00adcu\u00adlar situa\u00adti\u00adon, at any time to pro\u00adces\u00adsing of per\u00adso\u00adnal data con\u00adcer\u00adning him or her which is per\u00adfor\u00admed based on Art. 6 Para. 1 lit e or lit. f GDPR. The also appli\u00ades to pro\u00adfil\u00ading based on the\u00adse legal provisions.<\/p>\n\n\n\nAXICA will no lon\u00adger pro\u00adcess the per\u00adso\u00adnal data in the case of an objec\u00adtion, unless AXICA can pro\u00advi\u00adde com\u00adpel\u00adling legi\u00adti\u00adma\u00adte grounds for the pro\u00adces\u00adsing which over\u00adri\u00adde the inte\u00adrests, rights and free\u00addoms of the data sub\u00adject or the pro\u00adces\u00adsing ser\u00adves the pur\u00adpo\u00adse of estab\u00adli\u00adshing, exer\u00adcis\u00ading or defen\u00adding legal claims.<\/p>\n\n\n\n
Whe\u00adre AXICA pro\u00adces\u00adses per\u00adso\u00adnal data for direct mar\u00adke\u00adting pur\u00adpo\u00adses, the data sub\u00adject has the right to object at any time to the pro\u00adces\u00adsing of per\u00adso\u00adnal data for such mar\u00adke\u00adting. The same shall app\u00adly to pro\u00adfil\u00ading to the ext\u00adent that it is rela\u00adted to such direct mar\u00adke\u00adting. Whe\u00adre the data sub\u00adject objects to the pro\u00adces\u00adsing for direct mar\u00adke\u00adting pur\u00adpo\u00adses vis-\u00e0-vis AXICA, AXICA will stop pro\u00adces\u00adsing the per\u00adso\u00adnal data for such purposes.<\/p>\n\n\n\n
The data sub\u00adject also has the right to object, on grounds rela\u00adting to his or her par\u00adti\u00adcu\u00adlar situa\u00adti\u00adon, to the pro\u00adces\u00adsing of per\u00adso\u00adnal data con\u00adcer\u00adning him or her, per\u00adfor\u00admed by AXICA for sci\u00aden\u00adti\u00adfic or his\u00adto\u00adri\u00adcal rese\u00adarch pur\u00adpo\u00adses or sta\u00adtis\u00adti\u00adcal pur\u00adpo\u00adses pur\u00adsu\u00adant to Art. 89 Para. 1 GDPR, unless the pro\u00adces\u00adsing is neces\u00adsa\u00adry for per\u00adforming a task car\u00adri\u00aded out for reasons of public interest.<\/p>\n\n\n\n
Whe\u00adre a data sub\u00adject wis\u00adhes to exer\u00adcise his or her right to object, such per\u00adson can do so by direct\u00adly cont\u00adac\u00adting the con\u00adtrol\u00adler respon\u00adsi\u00adble for pro\u00adces\u00adsing. Every data sub\u00adject impac\u00adted by the pro\u00adces\u00adsing of per\u00adso\u00adnal data has the right not to be sub\u00adject to a decis\u00adi\u00adon based sole\u00adly on auto\u00adma\u00adted pro\u00adces\u00adsing, inclu\u00adding pro\u00adfil\u00ading, which pro\u00addu\u00adces legal effects con\u00adcer\u00adning him or her or signi\u00adfi\u00adcant\u00adly affects such per\u00adson in a simi\u00adlar way \u2013 unless such decision:<\/p>\n\n\n\n\n- is neces\u00adsa\u00adry for con\u00adclu\u00adding or ful\u00adfil\u00adling a con\u00adtract bet\u00adween the data sub\u00adject and the con\u00adtrol\u00adler or<\/li>\n\n\n\n

- is based on the data sub\u00adjec\u00adt\u2019s expli\u00adcit consent.<\/li>\n<\/ul>\n\n\n\n
If the decis\u00adi\u00adon is neces\u00adsa\u00adry for con\u00adclu\u00adding or ful\u00adfil\u00adling a con\u00adtract made bet\u00adween the data sub\u00adject and AXICA or if it is based on the data sub\u00adjec\u00adt\u2019s expli\u00adcit con\u00adsent, AXICA will imple\u00adment sui\u00adta\u00adble mea\u00adsu\u00adres to safe\u00adguard the rights and free\u00addoms and the legi\u00adti\u00adma\u00adte inte\u00adrests of the data sub\u00adject; inclu\u00adding at least the right to obtain human inter\u00adven\u00adti\u00adon on the con\u00adtrol\u00adler\u2019s part, to express the data subject\u2019s own point of view and to con\u00adtest the decision.<\/p>\n\n\n\n
If the data sub\u00adject wis\u00adhes to exer\u00adcise his or her rights in rela\u00adti\u00adon to auto\u00adma\u00adted decis\u00adi\u00adons, he or she can do so at any time by cont\u00adac\u00adting the con\u00adtrol\u00adler respon\u00adsi\u00adble for data processing.<\/p>\n\n\n\n
9. Right to with\u00addraw con\u00adsent for data pro\u00adces\u00adsing:<\/strong>
Every data sub\u00adject impac\u00adted by the pro\u00adces\u00adsing of per\u00adso\u00adnal data is entit\u00adled to with\u00addraw his or her con\u00adsent to the pro\u00adces\u00adsing of per\u00adso\u00adnal data at any time. The con\u00adsent should be with\u00addrawn in the same man\u00adner as it was given.

The super\u00advi\u00adso\u00adry aut\u00adho\u00adri\u00adty whe\u00adre the com\u00adplaint was lodged will inform the com\u00adplainant on the pro\u00adgress and the out\u00adco\u00adme of the com\u00adplaint inclu\u00adding the pos\u00adsi\u00adbi\u00adli\u00adty of a judi\u00adcial reme\u00addy pur\u00adsu\u00adant to Art. 78 GDPR.<\/p>\n\n\n\n
